NZ SPHERE

REFUND & CANCELLATION POLICY

Effective Date: 21 October 2026
Last Updated: 22 October 2026

1. PURPOSE AND APPLICATION

NZ SPHERE is a New Zealand-based digital advertising platform providing businesses and organisations with advertising spaces on an interactive digital sphere.

This Refund & Cancellation Policy establishes the conditions governing refunds, cancellations, advertising-space activation and termination of advertising services.

This policy forms part of, and should be read alongside, the NZ SPHERE Terms & Conditions.

By purchasing advertising space, customers agree to the applicable Terms & Conditions and acknowledge this policy.

Nothing in this policy excludes, restricts or modifies any statutory right or remedy that cannot lawfully be excluded.

2. ADVERTISING PURCHASES AND SERVICE PERIODS

2.1 Pricing

NZ SPHERE currently offers standard advertising spaces for NZD $20 per space for a 12-month advertising period.

The applicable purchase price is the amount displayed and accepted at checkout.

2.2 Advertising Period

Each purchased advertising space provides a 12-month advertising period commencing on its Activation Date, as defined in the NZ SPHERE Terms & Conditions.

2.3 Activation

Advertising spaces are generally allocated and activated following successful payment, validation of the relevant business information and completion of any required verification procedures.

2.4 No Automatic Renewal

Advertising purchases do not automatically renew unless the customer has expressly agreed to a separate recurring-payment arrangement.

No additional advertising-period payment will be collected without appropriate authorisation.

2.5 Expiry

Advertising spaces may be deactivated or removed when their advertising period expires without renewal.

Expiry of a completed advertising period does not create an entitlement to a refund.

3. CHANGE-OF-MIND REFUNDS

NZ SPHERE provides a digital advertising service that may commence shortly after payment.

Accordingly, change-of-mind refunds are not ordinarily available once a valid purchase has been completed, except where required by applicable law.

Change-of-mind circumstances include:

  • Deciding that advertising is no longer required.

  • Changing business priorities or marketing strategies.

  • Purchasing an advertising space without subsequently using it.

  • Dissatisfaction with advertising performance, visitor numbers, enquiries or sales where no specific result was guaranteed or misrepresented.

  • Choosing to advertise with another provider.

NZ SPHERE may, at its discretion, approve a voluntary refund in exceptional circumstances.

Any discretionary refund is assessed individually and does not establish an obligation to approve similar requests.

This section does not affect remedies arising from misrepresentation, material service failures or other legally enforceable rights.

4. CIRCUMSTANCES ELIGIBLE FOR REFUNDS

Refunds, corrections or other appropriate remedies may be provided in the following circumstances.

4.1 Failure to Provide the Purchased Service

Where NZ SPHERE receives payment but cannot provide the purchased advertising space, reasonable efforts will be made to resolve the issue.

If NZ SPHERE cannot provide the agreed service within a reasonable timeframe, an appropriate refund or other legally required remedy will be provided.

4.2 Duplicate or Incorrect Payments

Verified duplicate payments, accidental overcharges and payment-processing errors will be investigated.

Where an amount has been collected in error, NZ SPHERE will arrange an appropriate correction or refund.

Separate purchases of additional advertising spaces are not considered duplicate payments merely because they were made by the same customer.

4.3 Material Service Failure

Where a material failure prevents NZ SPHERE from delivering its contractual advertising obligations, the customer may be entitled to an appropriate remedy.

Depending on the circumstances and applicable law, this may include:

  • Rectification of the service failure.

  • Restoration or extension of advertising services.

  • A partial or full refund.

  • Another remedy required by law.

Any proposed alternative remedy will not replace a customer’s statutory entitlement without their agreement where such agreement is required by law.

4.4 Permanent Service Discontinuation

If NZ SPHERE permanently discontinues its paid advertising services before a customer’s advertising period expires, customers will receive an appropriate refund for the unused portion of their prepaid advertising period, unless a different remedy is lawfully agreed.

Any additional statutory remedies remain unaffected.

4.5 Rejection Before Activation

If NZ SPHERE declines to provide a purchased advertising space before activation for reasons unrelated to a customer’s breach of the Terms & Conditions, the payment for that undelivered service will be refunded.

Where rejection results from inaccurate, fraudulent, unlawful or prohibited customer information or conduct, any refund will be assessed in accordance with the Terms & Conditions and applicable law.

5. ACTIVATION DELAYS AND CUSTOMER ERRORS

Customers are responsible for submitting accurate business information and completing the registration requirements necessary for activation.

Where an incorrect business reference, incomplete information or another customer-related error delays activation, NZ SPHERE may request additional information to resolve the issue.

A temporary, reasonably remediable activation delay does not automatically entitle a customer to a refund.

Where NZ SPHERE is responsible for an unreasonable delay or is unable to provide the purchased service, applicable contractual and statutory remedies remain available.

6. CUSTOMER CANCELLATIONS

6.1 Right to Request Cancellation

Customers may request cancellation of one or more advertising spaces at any time using NZ SPHERE’s published contact details.

NZ SPHERE may require reasonable verification of the requester’s authority before processing a cancellation.

6.2 Effect of Cancellation

Cancellation may result in the deactivation or removal of the affected advertising spaces and associated paid advertising content.

6.3 Refunds Following Voluntary Cancellation

Voluntary cancellation does not ordinarily entitle a customer to a refund for the remaining unused advertising period.

Customers purchase a defined 12-month advertising service rather than a month-to-month subscription.

6.4 Statutory Rights

Where a cancellation arises from circumstances giving rise to a legal right to a refund or other remedy, that entitlement will be honoured.

NZ SPHERE will not rely on a voluntary-cancellation provision to defeat a statutory right.

7. SUSPENSION OR TERMINATION BY NZ SPHERE

NZ SPHERE reserves the right to suspend, refuse or terminate advertising services in circumstances permitted by its Terms & Conditions and applicable law.

Such circumstances may include:

  • Fraudulent or unauthorised transactions.

  • False, misleading or unlawfully submitted business information.

  • Infringement of intellectual property or other legal rights.

  • Prohibited advertising content.

  • Material breaches of the Terms & Conditions.

  • Misuse of the platform or conduct compromising its security or operation.

Where termination results from a customer’s material breach, a refund will not ordinarily be provided solely because the advertising service has been suspended or terminated.

However, any refund or remedy legally required in the circumstances will remain available.

Termination Without Customer Breach

Where NZ SPHERE elects to terminate an otherwise compliant customer’s paid advertising service for its own convenience before the agreed advertising period expires, an appropriate refund for the unused prepaid period will be provided.

This provision does not limit any additional rights available under applicable law.

8. PLATFORM INTERRUPTIONS AND AVAILABILITY

NZ SPHERE aims to provide a reliable and accessible digital advertising platform.

However, temporary interruptions may occur because of scheduled maintenance, security updates, technical failures, hosting interruptions or circumstances beyond NZ SPHERE’s reasonable control.

Minor or temporary interruptions do not automatically create an entitlement to a refund.

NZ SPHERE will take reasonable steps to investigate and remedy service interruptions within its control.

Where an interruption materially affects the service purchased, any appropriate contractual or statutory remedy will be assessed according to its nature, duration and impact.

Nothing in this section excludes liability or remedies that cannot lawfully be excluded.

9. REFUND REQUESTS AND PROCESSING

9.1 Submitting a Request

Customers seeking a refund should contact NZ SPHERE through the official contact information published on its website.

To assist with verification, customers may be asked to provide:

  • Registered business name.

  • NZ SPHERE Business Reference.

  • Email address associated with the purchase.

  • Approximate purchase date.

  • Description of the issue or reason for the request.

Customers must not submit passwords, complete payment-card numbers or other unnecessary sensitive financial information.

9.2 Assessment

NZ SPHERE will investigate refund requests fairly, reasonably and in good faith.

Requests will be assessed against:

  • The circumstances of the purchase.

  • The status of the advertising service.

  • Relevant transaction and activation records.

  • The applicable Terms & Conditions.

  • This Refund & Cancellation Policy.

  • Applicable New Zealand law.

NZ SPHERE may request additional information reasonably necessary to verify a claim.

9.3 Refund Method

Approved or legally required refunds will ordinarily be processed through the original payment provider and returned to the original payment method.

Where this is not reasonably possible, an appropriate alternative payment method may be arranged following verification.

9.4 Processing Time

NZ SPHERE will arrange approved or legally required refunds within a reasonable timeframe.

The time required for funds to appear in a customer’s account may depend on the relevant bank, card issuer or payment provider.

NZ SPHERE is not responsible for delays outside its reasonable control, without prejudice to its applicable legal obligations.

9.5 Multiple Advertising Spaces

Where a purchase includes multiple advertising spaces, any refund will generally relate only to the affected spaces unless the circumstances, agreement or applicable law require otherwise.

10. EFFECT OF REFUNDS

10.1 Full Refunds

Where a full refund is issued for a purchased advertising space, the corresponding paid advertising entitlement may be cancelled and the associated advertising presence deactivated or removed.

10.2 Partial Refunds

Where a partial refund is issued, the continued provision or adjustment of advertising services will be determined by the applicable circumstances, any agreement with the customer and relevant legal obligations.

10.3 Calculation of Refunds

Any refund calculated by reference to an unused advertising period will ordinarily be based on the amount actually paid for the affected advertising space and the proportion of the contracted period remaining.

This calculation does not limit any different or additional remedy required by law.

10.4 Payment Reversals

NZ SPHERE may investigate payment reversals, chargebacks and suspected unauthorised transactions.

Reasonable steps may be taken to prevent duplicate refunds and reconcile the relevant payment and advertising records.

Any suspension or adjustment of advertising services following a payment reversal remains subject to the Terms & Conditions and applicable law.

11. NEW ZEALAND LAW AND CUSTOMER RIGHTS

This policy is governed by the laws of New Zealand.

NZ SPHERE recognises its obligations under applicable legislation, including:

  • The Consumer Guarantees Act 1993, where applicable.

  • The Fair Trading Act 1986.

  • The Contract and Commercial Law Act 2017.

  • Other relevant New Zealand legislation.

Nothing in this policy excludes, restricts or modifies any legal right, guarantee or remedy that cannot lawfully be excluded, restricted or modified.

Where a provision of this policy conflicts with a mandatory requirement of New Zealand law, that legal requirement prevails.

Customers retain their rights to pursue applicable dispute-resolution procedures, courts, tribunals or regulatory remedies.

12. RELATIONSHIP WITH TERMS & CONDITIONS

This policy must be read together with the current NZ SPHERE Terms & Conditions.

The Terms & Conditions govern the broader contractual relationship between NZ SPHERE and its customers, including eligibility, advertising rights, content standards, platform operations and termination.

This policy provides the specific procedures and principles applicable to refunds and cancellations.

Where an inconsistency arises, the Terms & Conditions will govern to the extent permitted by law, provided that no applicable statutory right or remedy is diminished.

13. POLICY AMENDMENTS

NZ SPHERE may amend this policy to reflect changes in its services, operational requirements or applicable law.

Updated versions will be published on the NZ SPHERE website with a revised date.

Amendments will not retrospectively remove or reduce statutory rights or contractual entitlements arising from purchases completed before the amendments take effect.

14. CONTACT AND DISPUTE RESOLUTION

For refund requests, cancellations or questions concerning this policy, customers should contact NZ SPHERE through the official contact information published on its website.

NZ SPHERE encourages customers to raise concerns directly so they can be investigated and resolved promptly and fairly.

Where a dispute cannot be resolved informally, the dispute-resolution provisions of the NZ SPHERE Terms & Conditions will apply, without restricting any right to seek statutory relief.
